Chapter 1 General Provisions
Article 1 (Purpose)

The purpose of these OPEN API Terms and Conditions (these “T&Cs”) is to stipulate all aspects of use and other necessary matters with regards to use of the OPEN API service provided by the Korea Exchange (the “KRX”).

Article 2 (Definitions of Terms)

The definitions of the key terms used in these T&Cs are as follows. The terms not otherwise defined herein shall have the meanings ascribed to such terms in the applicable laws or have the ordinary meaning.

  1. ① "API", an abbreviation of Application Programming Interface, refers to the protocols defined by a data owner to provide data to a data user.
  2. ② "API Service" means a service provided by the KRX that allows users who have received data from the Market Data System (refers to KRX 's market information portal) to develop their own applications and services using the data.
  3. ③ "Authentication Key" means a unique value individually assigned by the KRX to an API User (defined below) to identify the API User as an individual or corporation authorized to use the API Service.
  4. ④ "API User" means any individual or corporation that uses the OPEN API Service provided by the KRX and agrees to these T&Cs.
Article 3 (Effectiveness and Amendment)
  1. ① These T&Cs shall be deemed effective when agreed by the API User in order to use the API Service.
  2. ② All services of the API Service are provided only if the API User agrees to these T&Cs.
  3. ③ To use the API Service, the API user shall agree to these T&Cs and apply for the issuance of an Authentication Key.
  4. ④ The KRX may amend these T&Cs if necessary, and when amended, shall post the main contents and effective date of the amendment on website. However, if such amendment has an effect of limiting any use of the API Users, it shall be announced to the user at least 15 days before the effective date and notified individually by email or other means.
  5. ⑤ The API User shall be liable for all damages caused by its failure to check the facts and any amendments to these T&Cs.
Article 4 (Matters Not Specified Herein)

Matters not specified in these T&Cs shall be governed by applicable laws and regulations and the KRX’s relevant business regulations.

Chapter 2 API Service Use, Conditions and Procedures
Article 5 (Method of Delivery)
  1. ① A person who wishes to use the API Service shall apply for an API Service Authentication Key from KRX.
  2. ② The KRX provides an Authentication Key to API Service applicants who meet certain requirements (e.g., agreeing to these T&Cs, and the API User shall manage the Authentication Key with the duty of care as a good manager.
  3. ③ The period of use of the API Service is one (1) year from the date on which the API provider provides the Authentication Key, and can be extended in one-year increments if the API User requests an extension before the expiration of the period of use.
  4. ④ The KRX may reject an application for an Authentication Key or request for extension pursuant to Paragraph 1 or Paragraph 3 above if there are any of the following reasons, in which case, the reason shall be notified to the API User:
    1. 1. where the application has been filed by a User who breaches any provision of these T&Cs; or
    2. 2. any other cases the KRX determines that the User's application is inappropriate.
  5. ⑤ The API Service shall be available 24 hours a day, all year round, in principle, unless there is any special disruption in the business or technology of the KRX; provided, however, that this shall not apply in any of the following cases, in which case, the relevant information shall be announced on the website in advance:
    1. 1. If there is a time or period separately set by the KRX for regular system maintenance or other similar events; or
    2. 2. If there is a service time separately set by the KRX for some services.
Article 6 (Notes for Using the Service)
  1. ①When configuring the result of the API Service, the API User shall not include items falling under any of the followings:
    1. 1. items against public order and morals;
    2. 2. items relevant to any criminal activity;
    3. 3. items undermining national or social interest;
    4. 4. items defamatory or otherwise harmful to others; or
    5. 5. items interfering with the sound use of the Service, such as damaging the API Service.
  2. ② API Users may only use the API Service for non-commercial purposes and may not charge third parties any consideration for the results of the API Service.
  3. ③ The API User shall not insert other items before, after, or in the middle of the results of the API service or distort any of them and shall not cause others to misunderstand the contents and intentions of the results. In addition, the API User shall not arbitrarily modify any contents provided by the API Service, including, but not limited to, a URL.
  4. ④ If the API User distorts the results of the API Service provided by the KRX, the KRX may take necessary civil and criminal measures against the API User.
Article 7 (Prohibitions)

User shall not engage in any of the following behaviors:

  1. ① User impersonation by deception;
  2. ② Transmission of malware such as viruses and worms;
  3. ③ Copyright violation, or combined or linked use with illegal information under the Act on Promotion of Information and Communications Network Utilization and Information Protection;
  4. ④ Forging or altering of the API connection method;
  5. ⑤ Transfer or giving away of the API Authentication Key, or use of the API Authentication Key as a collateral; or
  6. ⑥ Attempting to access without authorization, even if the access is not within the scope of the authorization.
Article 8 (Discontinuation of Service)
  1. ① The KRX may set and enforce limits on the scope of the API Service or specify separate service hours or the number of API requests.
  2. ② The KRX may temporarily discontinue the API Services if any of the following cases arises; provided that if it is unavoidable, the API Service may be discontinued without prior notice:
    1. 1. If the provision target of the API Service is changed due to any revision of applicable laws and thereby can no longer be utilized;
    2. 2. Regular system maintenance, expansions, and replacements;
    3. 3. In case where any technical defect is identified with regards to provision of the API Service; or
    4. 4. When a new API Service is added.
  3. ③ If any of the behaviors prohibited under Article 7 occurs, or the user violates these T&Cs, the KRX may discontinue the API Service and may take necessary measures, including legal measures.
  4. ④ The maximum number of requests for one (1) key shall be 10,000 a day (00:00 – 24:00 daily), and if the number exceeds the cap, the API Service may be discontinued.
  5. ⑤ The Authentication Key issued by the KRX may be deleted without prior notice if it is not used for twelve (12) months.
Article 9 (Obligations of API Users)
  1. ① API Users shall comply with the matters stipulated in these T&Cs and all other regulations and notices established by the KRX, and other applicable laws and regulations when using the API Service.
  2. ② API Users shall not engage in any behavior that interfere with the business of the KRX or defame the KRX.
  3. ③ In using the API Service, the API User shall fully assume any liability for his/her behavior, and the API User shall not represent the KRX under any circumstances and shall not engage in any behavior that may be misunderstood as representing the KRX.
  4. ④ The API User shall immediately notify the KRX of any change in name, contact information (including e-mail address), and the KRX shall not be liable for any damages caused by the API User’s failure to notify any change.
Article 10 (Copyright of API Service)
  1. ① The copyright of the API Service and related programs provided by the KRX is held by the KRX.
  2. ② API Users shall not infringe on the copyrights of the KRX and any third parties when using the API Service.
  3. ③ If the API User creates a page using the results of the API Service, such page shall expressly indicate that it is created by using "KRX statistical information"; provided, however, that if the KRX establishes a separate indication method, the User shall follow it.
Article 11 (Restrictions on Use of the API Service)
  1. ① The KRX may prohibit an API User from using the API Service if the API User fails to comply with applicable laws or these T&Cs.
  2. ② The API User may not provide the data provided by the KRX to any third parties.
  3. ③ The API User shall not use the data provided by the KRX after the corresponding Data Use Agreement is terminated due to expiration or cancellation.
  4. ④ If the API User violates Paragraph 2 above, the KRX may withdraw the authorization for using the API Service and suspend the API Service.
  5. ⑤ If any damage is caused to the KRX due to reasons attributable to the API User in connection with the use of the API Service, the KRX may claim for damages in addition to termination of the corresponding agreement pursuant to these T&Cs.
Chapter 3 Miscellaneous
Article 12 (Indemnification)
  1. ① The KRX shall not be liable for any damages caused by the API User's failure to comply with these T&Cs.
  2. ② The KRX does not guarantee accuracy and completeness with respect to any information errors, omissions or API Service failures.
  3. ③ If the API User edits the statistical information of the KRX and produces new additional information, the KRX shall not be responsible for such additional information.
  4. ④ The KRX is not obligated to intervene in any disputes between API Users and third parties that arise in connection with the API Service, and shall not be liable for any damages resulting therefrom.
  5. ⑤ The KRX does not guarantee the continued provision of statistical information or the continued provision of additional statistical information.
Article 13 (Jurisdiction)

In the event of a dispute in connection with these T&Cs, the Seoul Southern District Court shall be the exclusive court of first instance.

These T&Cs shall be effective as of August 8, 2022.
